Can you get bail over Christmas in NSW?

Being arrested over the Christmas period can be incredibly stressful, especially when courts and government offices operate on limited holiday schedules. The good news is that yes, you can apply for bail over Christmas, and the courts still process matters during the holiday shutdown.

Here, we’ll explain how bail works during the festive season, what delays you may face, and how we can help if a family member or friend has been taken into custody.

Do courts close over Christmas?

Local Courts are shut for public holidays, but they continue to operate in a reduced capacity. Importantly:

  • Bail Courts operate every day of the year in NSW. Newly arrested people usually appear in Court by audio-visual link (AVL).
  • Police can grant or refuse police bail at any time, including on Christmas Eve, Christmas Day and Boxing Day.
  • If police refuse bail, you will usually appear before an on-call magistrate at the earliest available opportunity.
  • This generally occurs within 24 hours unless the person is taken to hospital due to an acute physical or mental health issue.
  • There is seldom any delay for a fresh custody to apply for bail over Christmas.

This means that bail applications can still be heard quickly – even if courts aren’t fully open to the public.

What the court considers when deciding bail

The Bail Act 2013 (NSW) applies the same way at Christmas as it does the rest of the year. A magistrate will consider:

  • The seriousness of the charge
  • Any “show cause” requirements, if applicable
  • Your criminal history or bail breaches
  • Risks to the community, including the risk of reoffending or interfering with witnesses
  • Your ties to the community – employment, family, stable housing
  • Whether conditions (e.g. reporting, curfew, residence, surety) can mitigate risk

There is no special Christmas leniency, however, preparation and strong bail proposals can make a significant difference.

Delays you may encounter

The court system is thinner over Christmas, which may affect your application for bail in the following ways:

  • People who already applied for and were refused bail can’t normally make new bail applications on Public Holidays.
  • Bail Courts on Public Holidays are just for “fresh custodies” (this means newly arrested people). 

The main delays over Christmas come from:

  • Earlier “cut-off” times. Normally cut-off is around 2:30pm, but on public holidays it’s nearer 9am. This means most people arrested after that time spend the night in custody and appear the next day.
  • People who were already refused bail before the Christmas period began.
  • People who require medical or psychiatric assessment or stabilisation.
