The police are now issuing Court Attendance Notices to attend court 8 weeks from the date of being charged or more. If you have received a Court Attendance Notice this may be very worrying. You may prefer that the matter be dealt with quickly. It may be possible to have your matter listed before the Court and dealt with at an earlier date. The Habitual Offender Scheme has been abolished in NSW in response to statistics that show that longer disqualification periods have little to no deterrent effect. If you were once declared a Habitual Offender, you might be eligible to have your Habitual Offender Disqualification removed. After providing us with the necessary documents, we will commence the process with the Roads and Maritime Services (‘RMS’) for the disqualification removal.
Can I remove the disqualification?
Depending on your individual circumstances, you will need to have complied with your disqualification for either 2 or 4 years and NOT have been convicted of any serious driving offence (see below).
When would I not be eligible?
If you have been convicted of any of the following driving offences:
- Murder or manslaughter caused by the use of a motor vehicle
- An offence under the Crimes Act that caused the death, grievous bodily harm or wounding by a motor vehicle
- Predatory driving or police pursuits under the Crimes Act
- Negligent driving causing death or grievous bodily harm
- Intentional menacing driving
- Failing to stop and assist after impact causing death or grievous bodily harm.
What is the process involved?
From start to finish, these are the steps you can expect to go through:
- Prepare a “Driving record application for disqualification removal order” Form
- Lodge the Form with the RMS
- Receive a Letter from the RMS declaring your eligibility
- Complete the “Local Court Application to remove the driver licence disqualification” Form
- Lodge the above Form with the Local Court and receive a hearing date
- Attend the Local Court regarding your application
- If successful in Court, apply for a new licence from the RMS
What if my application is denied?
You may not be able to re-apply for another 12 months.
